ARIZONA BRIEF STATEMENT OF CURRENT ELECTION LAWS

Registration — no later than October 10, 2022

General Election Date — November 8, 2022

The Basics

  • Arizona permits online voter registration, early voting, and no-excuse absentee voting.

  • Polls are open from 6:00 a.m.- 7:00 p.m.

  • Voters are required to present non-photo identification at the polls.

  • In Arizona, conviction of a felony suspends the person's right to vote until they have been restored to civil rights. While first time offenders are automatically restored to civil rights upon completion of their sentence, those with repeat felony offenses must appeal to the court or the judge who discharged them.

  • On May 11, 2021, the Governor signed into law the following modifications to the state's Permanent Early Voting List procedures:

    • Renamed the Permanent Early Voting List (PEVL) as the Active Early Voting List (AEVL).

    • Provided for a voter's removal from the AEVL if he or she "fails to vote an early ballot in all elections for two consecutive election cycles" and fails to respond to written notice from the county recorder (the voter must "confirm in writing the voter's desire to remain on the active early voting list" and "return the completed notice to the county recorder or other office in charge of elections within ninety days after the notice is sent to the voter").

Registration Rules

Voter Registration Applications must be completed 29 days prior to an election in order to be "registered to vote” in that election. Who can register to vote in an Arizona election?

  • a CITIZEN of the United States of America

  • a RESIDENT of Arizona

  • at least 18 YEARS OF AGE by the next general election

  • NOT a convicted FELON, unless civil rights are restore

  • NOT adjudicated INCOMPETENT (A.R.S. §14-5101)

Key ID Requirement Sources

SUMMARY: Arizona requires voters to present photo identification or two forms of non-photo identification (ID) while voting. DETAILS: One form of identification from List #1 or two different forms of identification from List #2 or 3. (A.R.S. § 16-579(A)(link is external).

List #1: Sufficient Photo ID including name and address (One Required)

  • Valid Arizona driver license

  • Valid Arizona non-operating identification card

  • Tribal enrollment card or other form of tribal identification

  • Valid United States federal, state, or local government-issued identification

List #2: Sufficient ID without a photograph that bears the name and address (Two Required)

  • Utility bill of the elector that is dated within 90 days of the date of the election. A utility bill may be for electric, gas, water, solid waste, sewer, telephone, cellular phone, or cable television

  • Bank or credit union statement that is dated within 90 days of the date of the election

  • Valid Arizona Vehicle Registration

  • Indian census card

  • Property tax statement of the elector's residence

  • Tribal enrollment card or other form of tribal identification

  • Arizona vehicle insurance card

  • Recorder's Certificate

  • Valid United States federal, state, or local government-issued identification, including a voter registration card issued by the County Recorder

  • Any mailing to the elector marked “Official Election Material”

List #3: Mix & Match from Lists #1 & #2 (Two Required)

  • Any valid photo identification from List 1 in which the address does not reasonably match the precinct register accompanied by a non-photo identification from List 2 in which the address does reasonably match the precinct register

  • U.S. Passport without address and one valid item from List 2

  • U.S. Military identification without address and one valid item from List 2
